While I have a great deal of experience with successfully reorganizing small businesses in the Omaha metropolitan area and throughout Nebraska and Iowa utilizing the provisions of chapter 11 of the United States Bankruptcy Code, I am a novice at blogging. So novice in fact, that this is my very first blog ever. I intend to become a regular.

Small businesses, whether incorporated, operating as an LLC, a partnership or even as a sole proprietorship can benefit from reorganization if they are having financial difficulties. In the current economy, that includes many, many businesses. The mistake many business owners make is waiting too long to obtain professional advice. If counsel is sought soon enough, it is more likely that an out of court workout or a "pre-packaged" bankruptcy can be accomplished.

Chapter 11 is not a magic wand, but sometimes it seems like it. When used properly, it can stop creditors collection actions, lawsuits, foreclosures, repossessions, evictions and harassment; it can restructure debts to lower the payments, lower the interest rates, break certain leases, stretch out tax obligations, postpone payments and yet keep assets and property, and most importantly keep you in control of your business; the day to day operating decisions as well as long term planning.
