United States Senators White house from Rhode Island and Warren from Massachusetts have introduced a bill in the Senate called “The Medical Bankruptcy Fairness Act of 2014” (S.2471).  It is designed to help families with a financial burden caused by the costs of illnesses or injuries.  The study that led them to introduce this proposed legislation found two startling facts: 1) medical bills are the leading cause of personal bankruptcies in the United States today; and 2) Three fourths of the families driven to bankruptcy because of health related costs are actually covered by health insurance.

Among other features, their bill would provide that people filing bankruptcy when most of their debt is medical could receive a more streamlined treatment, avoiding some of the hurdles of procedure and cost such as the mandatory credit counseling.  The bill would include people who have lost income because of medical issues and those who have lost child support due to injury or illness of the person supposed to pay.
